U.S. Attorney Brendan V. Johnson announced that Josie Kills Plenty, age 29, of Parmelee, appeared before U.S. District Judge Roberto A. Lange on August 30, 2011, and pled guilty to Count II of an Indictment that charged her with Assault with a Dangerous Weapon. The maximum penalty upon conviction is 10 years' imprisonment.
The charge stems from an incident on February 10, 2011, when Kills Plenty and the victim were at a home in Parmelee consuming alcohol. During the course of the evening, the Defendant became upset, grabbed a kitchen knife, and attempted to stab the victim in the neck. The victim put an arm up to block the knife and was stabbed in the right arm, creating a 3-4 centimeter puncture wound. Kills Plenty then called the police, told them what she had done, and fled.
The investigation was conducted by the Rosebud Sioux Tribe Law Enforcement Division. The case is being prosecuted by Assistant U.S. Attorney Meghan N. Dilges.
A presentence investigation was ordered, and a sentencing date was set for November 28, 2011. The defendant was remanded to the custody of the U.S. Marshal pending sentencing.
